Understanding Homeowners Associations

Many communities are governed by Homeowners Associations (HOAs), which are non-profit corporations managed by a duly elected Board of Trustees. The HOA is responsible for maintaining common areas and governing the community in accordance with the provision of legal documents, including CC&Rs, Bylaws, and Articles of Incorporation. Membership in the HOA is automatic and mandatory for all homeowners.

The CC&Rs, or Covenants, Conditions, and Restrictions, are the governing legal documents that set up the guidelines for the operation of the planned community. The Bylaws define the duties of the various offices of the Board of Directors (Trustees), the terms of the Directors (Trustees), the membership's voting rights, required meetings and notices of meetings, and the principal office of the Association.

The Homeowners Association is governed by a Board of Directors, elected by the homeowners, who oversee the business of the Association. Most associations have developed Rules and Regulations as provided for in the CC&Rs and adopted by the Board of Trustees. These rules provide direction to homeowners for common courtesies with regard to parking, vehicles, pets, and pool use hours.
