The Basic Steps at Closing

Closing a real estate transaction involves several crucial steps. At Limestone County Title Company, we follow five basic steps to ensure a smooth and successful transaction:

1. Starting the Process: The process begins when a sales contract is signed and delivered to our closing agent, along with a deposit check. Upon accepting the escrow, our team opens a title order and begins processing the file, ordering tax information, loan payoffs, surveys (when necessary), inspections, reports, hazard and other insurances, and legal papers. A title search is also ordered.

2. Title Search and Examination: Our team conducts a thorough search of public records related to the property. We examine the documents found during the search and verify the legal owner, as well as determine the debts owed against the property. Upon completion of the search and examination, we prepare a title commitment/preliminary report and send it to the interested parties.

3. Document Preparation and Request to Produce: Our team reviews the new lender's instructions and requirements, as well as those from other parties involved in the transaction. We assemble charges, prepare closing statements, and schedule the closing.

4. Settlement/Closing the Transaction: Our escrow/settlement agent oversees the closing of the transaction. The seller signs the deed and closing affidavit, while the buyer signs the new note and mortgage. The old loan is paid off, and seller, real estate professionals, attorneys, and other parties present at the closing are paid.

5. Post-Closing: Following the signing, our team forwards payment to any prior lender, pays all parties who performed services in connection with your closing, records the transaction documents in the county where the property is located, and prepares and sends title insurance policies to the new lender and the new property owner.
